Parole Board Process
There are two forms of reviews conducted and those are
- The paper-based review
- The oral hearing.
Paper Review: This usually takes prior to the sentence tariff expiry date. At this Review the Parole Board will consider whether the Prisoner has shown that he is suitable for a move to less restrictive prison.
There is no formal hearing. What happens a dossier of reports is prepared by the Prison and Probation Services and then sent to the Parole Board. This dossier is disclosed to the prisoner and submissions in support can be made in addition to the Dossier.
Oral Hearing: This hearing will determine whether a prisoner is suitable for release. The Parole Board will consider this application at the hearing.
The hearings take place at the Prison where the Prisoner is located and serving his sentence. The prisoner is entitled to seek legal assistance and representation before the Parole Board.
If the Parole Board order release of the Prisoner then this decision will be accepted by all including the Secretary of State and the prisoner will be released.
Should the Parole Board refuse to release the prisoner a further review of incarceration will take place at a future date set by the Secretary of State. Such reviews no more than 2 years after the first hearing.
The decisions of the hearing and further reviews can be challenged, if due process is not followed.
Adjudications
Any prisoner who is alleged to have breached or broken a prison rule can be made subject to internal disciplinary proceedings within the Prison. These hearing hearings are conducted in front of a District Judge and the Prisoner is entitled to be represented. This is a service that we can provide.
