Terrorism

 

Post 9/11 a new restrictive form of legislation was introduced to curb the threat of home grown fundamentalists who may then commit acts of terrorism in the UK. As a result the Police especially the Counter Terrorism Unit have been given more Powers to Stop, to Search and to detain.

Under the Police and Criminal Evidence Act 1984 (PACE) there are statutory Powers which govern the Police and there is a Code of Practice in Place. Under normal arrest Provisions a person can be detained at a Police station for no more than 96hours or 4 days, under the Terrorism legislation this can be 672hours or 28 days.

Under PACE legal access can be denied in exceptional circumstances but under the Terrorism provisions it can be used easier.

There is a separate Code of Practice just for those arrested under the Terrorism legislation and that curtails the rights somewhat.

Initially all matters which arose were dealt with in London, but more and more are now being dealt with locally.
