Judicial Review


Where a decision made by a Court, a tribunal, A public body or any other body which can be deemed as Public then any decision made by that body has to be reasonable, proportionate, unbiased, with error, without delay and with lawful power, if it does not then that decisions can be challenged.

We are able to provide this service as one of our staff has a Masters Degree in Judicial Review and has successfully challenged decisions in the Divisional Court. The most notable one be the leading authority on the use and serving of CCTV evidence (R v Calderdale Magistrates Court ex parte Donahue & Cutler 2001)

The process can be difficult but those who have mounted challenges in the High Court previously are aware of what is required and what is expected by the Judges who sit in the High Court.

There are limits on using this process, were there may an alternative provision of relief but on the whole this principle can be circumvented. There is a time limit on bringing such actions and it is 3 months from the date of the decisions, so it is vital that advise is sought early, otherwise this may not be able to be relied upon.
